Distance Sales Agreement

This agreement sets out the rights and obligations of the parties regarding the services you purchase online from Kullya. Information specific to your order is added to the agreement on the payment screen; after your approval, a copy of the agreement is sent to your email address. This English version is provided for convenience; the Turkish text prevails.

Article 1 — Parties

Zuhuri Mehmet Sk. 1.2. Girişler No: 7 İç Kapı No: 10, Selçuklu / Konya. Phone: 0543 212 21 20. Email: info@kullya.com.

Buyer: the natural or legal person who is a member of the Kullya panel and whose name, contact and billing information appear on the payment screen (the "Buyer").

Article 2 — Subject

The subject of this agreement is to determine the rights and obligations of the parties, in accordance with Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, regarding the provision of the service ordered electronically by the Buyer through kullya.com, whose nature, term and sales price are stated in the order summary on the payment screen.

Article 3 — Service subject to the agreement

The type of service (plan, AI credit, domain name, template or module license, Support Request), its name, term, quantity, price excluding and including VAT, payment method and order date appear in the order summary on the payment screen and form an integral part of this agreement.

The detailed scope of the services is set out on the pricing page, and the rules of use in the Terms of Use and Membership Agreement.

Article 4 — Pre-contractual information

The Buyer acknowledges that, before the agreement was concluded, they read the Pre-Information Form, were informed about the essential characteristics of the service, the sales price, the payment method, the conditions of performance, the right of withdrawal and the cases in which this right cannot be exercised, and the complaint and dispute resolution channels, and that they confirmed this electronically.

Article 5 — Performance and delivery

The service is made available immediately in the Buyer's Kullya account after the payment is approved by the payment institution. Domain name registration depends on the processing time of the relevant registry; if registration cannot be completed within 30 days, the amount paid is refunded within 14 days.

If the service cannot be provided for any reason after payment, the Seller notifies the Buyer immediately and, at the Buyer's request, refunds the price within 14 days at the latest.

Article 6 — Price and payment

The service price is the total amount including taxes shown on the payment screen and is collected by card through PayTR Ödeme ve Elektronik Para Kuruluşu A.Ş. If the price is not paid to the Seller by the cardholder's bank for any reason, the Seller is released from the obligation to provide the service.

For subscription renewals, the plan price remains fixed throughout the subscription; VAT is added at each collection at the rate applicable on that date. The invoice is issued with the Buyer's billing information after payment and delivered electronically.

Article 7 — Subscription term, renewal and termination

Monthly plans are open-ended subscriptions and continue every month until the Buyer cancels. The Buyer may cancel the subscription from the panel at any time without paying a penalty; the cancellation takes effect at the end of the paid period and the price for that period is not refunded.

Annual plans are fixed-term subscriptions. For a consumer Buyer, the annual subscription does not renew automatically at the end of the term; the Seller sends the Buyer a notice before expiry and renewal takes place only with the Buyer's approval. For a Buyer purchasing for commercial purposes, the annual plan renews on the same terms unless the Buyer turns off automatic renewal.

If the renewal price cannot be collected, the service continues during a 14-day grace period and reminders are sent; at the end of the period the account is moved to the free level, data is not deleted, and the previous level is restored once payment is made.

The subscription can be terminated from the panel in a way that is no more difficult than the way it was set up; the Buyer may also send a termination notice to info@kullya.com if they wish. A termination request is fulfilled within 7 days at the latest.

Article 8 — Right of withdrawal

A consumer Buyer has the right to withdraw within 14 days from the date the agreement is concluded, without giving any reason. The withdrawal notice is sent by email to info@kullya.com or in writing to Hacıkaymak Mah. Zuhuri Mehmet Sk. 1.2. Girişler No: 7 İç Kapı No: 10, Selçuklu / Konya.

Under Art. 15(1)(ğ) and (h) of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for plan, template and module license, Support Request and domain name registration services that are performed instantly in electronic form and whose performance has begun, with the Buyer's approval, before the withdrawal period expires. On the payment screen, the Buyer additionally confirms that they request the immediate start of performance of the service and know that they will therefore lose the right of withdrawal.

If the AI credit has not been used at all, the Buyer may exercise the right of withdrawal within 14 days. The Seller refunds the price collected, without charging any fees, to the card used for payment and through the same payment instrument, within 14 days at the latest from the date the withdrawal notice reaches it.

Article 9 — Obligations of the parties

The Seller is obliged to provide the service in accordance with the agreement, the pre-contractual information and the characteristics on the pricing page, to process personal data in accordance with the KVKK Privacy Notice, and to take reasonable care to provide the service without interruption. Planned maintenance is announced in advance wherever possible.

The Buyer acknowledges that the information they provided on the payment screen is accurate, that they will not share their account with third parties, and that they will use the service in accordance with the Terms of Use and Membership Agreement and the Acceptable Use Policy.

Article 10 — Dispute resolution

For disputes arising from this agreement, the consumer arbitration committees at the Buyer's place of residence or where the transaction was made have jurisdiction within the monetary limits announced by the Ministry of Trade; for disputes above these limits, the consumer courts have jurisdiction after the mediation precondition has been fulfilled. For a Buyer purchasing for commercial purposes, the jurisdiction clause in the Terms of Use and Membership Agreement applies.

Article 11 — Records and entry into force

The Seller keeps this agreement, the pre-contractual information and the Buyer's approval records (the approved text, its version, the time of approval and the IP address) for at least three years. After the purchase is completed, the Buyer can access the agreement through the order history in the panel and the copy sent to their email address.

This agreement is concluded and enters into force when the Buyer gives electronic approval on the payment screen. Last updated: November 4, 2026.
